  • FDA (Food and Drug Administration) – Food and Drug Administration describes regulations and requirements, including for clinics in the United States, which receive samples of materials from other countries.
  • ICAO and IATA – organizations that describe transport regulations and requirements for biomaterials onboard aircraft.

If the samples are shipped from abroad, the customs office should be provided with invoices that describe the quantity of material that is being shipped, the characteristics of the equipment in which it travels. the sender and consignee details, export/import dates, and transport route which is being used. Guidelines for Export of Embryos and Gametes, Cryo shipping costs in India


The Directorate General of Foreign Trade prohibited import of human embryos vide their
notification no. 25/2015-2020 issued on 26th October, 2015 in the country. Simultaneously
the Ministry of Home Affairs vide their notification no. 25022/74/2011-F.I (Vol. III) dated 3rd
November, 2015 banned surrogacy in India for foreign couple including OCI/PIO. Because
of these two notifications following three situations have arose in the country, Cryo shipping costs in India.

  1. Imported Embryos: Numbers of embryos which were imported for the purpose of
    surrogacy are lying at respective ART Clinic in the country and their owners are

    in India are now requesting to take their gametes outside India for the treatment of
    their infertility.
    Since the embryos and gametes belong to the infertile couples and under the present
    regulatory provisions in the country, the permission may be given to these infertile couples
    to export their embryos and gametes for treatment of their infertility based on the following
    guidelines.
    I. The infertile couple should submit the application for export of embryos or gametes
    to the ICMR along with appropriate documentations.
    II. Based on the following documental proof, ICMR should issue a No Objection
    Certificate (NOC) to export the embryos or gametes.
    III. Based on the NOC issued by the ICMR, the respective port should allow exporting
    the embryos or gametes.
    IV. ICMR should issue the NOC for all the above mentioned three categories based on
    the following documental proof.
